1. Acceptance of these Terms
By downloading, installing or using the Icekit iOS application (the “App”) or by accessing icekitmaintenance.com (the “Site”), you agree to be bound by these Terms of Use and the End-User License Agreement set out below (together, the “Terms”). If you do not agree to these Terms, do not install or use the App.
If you use the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. License grant (EULA)
Subject to your compliance with these Terms, Packlooap Pty Ltd (“Packlooap”, “we”) grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on any compatible Apple device that you own or control, solely for your personal, non-commercial use.
All rights not expressly granted under these Terms are reserved by Packlooap and its licensors.
3. Use restrictions
You agree not to:
- copy, modify, distribute, sell, rent, lease or sublicense the App or any part of it;
- reverse engineer, decompile, disassemble or attempt to derive the source code of the App, except to the extent that such restrictions are prohibited by applicable law;
- remove or alter any copyright, trademark or other proprietary notices contained in the App;
- use the App for any unlawful, fraudulent or harmful purpose, or in any manner that could damage, disable or impair the App;
- use any automated means to access, scrape or use the Site;
- use the App in a way that violates Apple's App Store Terms of Service.
4. Local data, no account
Icekit does not require you to create an account. Your equipment profiles, maintenance logs, and service history are stored locally on your device. You are solely responsible for the data you store in the App and for keeping backups (for example through Apple's standard device backup features).
If you uninstall the App, the data stored locally by the App on that device will be deleted.
5. Intellectual property
The App and Site, including all software, design, text, graphics, logos, icons and other content, are owned by Packlooap Pty Ltd or its licensors and are protected by copyright, trademark and other intellectual-property laws. “Icekit” and the Icekit logo are trademarks of Packlooap Pty Ltd. Nothing in these Terms grants you any right or licence to use any of our trademarks.
6. Third-party services
The App is distributed via Apple's App Store, which is subject to Apple's terms. The App may link to third-party websites or services that we do not control. We are not responsible for the content, privacy practices, or availability of any third-party services.
7. Disclaimer of warranties
The App and Site are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, Packlooap does not warrant that the App will be uninterrupted, secure, or error-free; that defects will be corrected; or that the App is free of viruses or other harmful components. Maintenance and safety decisions are your own — Icekit is a record-keeping aid and does not replace professional shop service or manufacturer guidelines.
8. Limitation of liability
To the maximum extent permitted by applicable law, Packlooap Pty Ltd and its affiliates, officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, use or goodwill, arising out of or in connection with your use of, or inability to use, the App or Site.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the App will not exceed the greater of (i) the amount you have paid to Packlooap for the App in the twelve (12) months preceding the event giving rise to the claim, or (ii) ten (10) US dollars.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply only to the extent permitted by law.
9. Indemnity
You agree to indemnify and hold harmless Packlooap Pty Ltd and its affiliates from and against any claims, liabilities, damages, losses and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or Site, your violation of these Terms, or your violation of any rights of a third party.
10. Term & termination
These Terms remain in effect for as long as you use the App or Site. You may terminate them at any time by uninstalling the App and ceasing to use the Site. We may suspend or terminate your right to use the App at any time, with or without notice, if you fail to comply with these Terms or for any other reason permitted by law.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination of these Terms.
11. Updates & changes
We may update the App and the Site, and we may change these Terms from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, notify users through the App or the Site. Your continued use of the App or Site after changes take effect constitutes acceptance of the updated Terms.
12. Apple-specific terms
This Section applies if you download the App from the Apple App Store. You acknowledge that these Terms are between you and Packlooap Pty Ltd only, and not with Apple, Inc. (“Apple”). Apple is not responsible for the App or its content.
- Scope of License. The license granted in Section 2 is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms of Service.
- Maintenance and Support. Packlooap Pty Ltd is solely responsible for providing any maintenance and support services with respect to the App, as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services in connection with the App.
- Warranty. Packlooap Pty Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
- Product Claims. Packlooap Pty Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
- Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Packlooap Pty Ltd, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
- Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
13. Governing law
These Terms are governed by the laws of the place of registration of Packlooap Pty Ltd, without regard to its conflict-of-laws principles. Mandatory consumer-protection laws of your country of residence remain unaffected. Disputes will be resolved in the competent courts of that jurisdiction, unless local mandatory law provides otherwise.
